PROFESSIONAL EXPERIENCE
Ms. McKibbin, Senior Associate, has a broad-based litigation practice representing both corporate and individual plaintiffs and defendants with primary emphasis on employment law. She represents clients before administrative agencies and in state and federal court, and handles matters involving harassment, discrimination, wrongful termination, and wage and hour issues, as well as preparing and evaluating client personnel manuals, and separation and severance agreements. Ms. McKibbin also provides Sexual Harassment Prevention Training to assist employers in complying with the on-going requirements of California Government Code Section 12950.1 (AB 1825). Her commercial business litigation practice includes contract disputes, unfair business practices claims, and trade secret misappropriation actions, and insurance defense.
Ms. McKibbin is responsible for all facets of pretrial and trial preparation including formulating and executing case strategy, conducting factual and legal investigation, propounding and responding to extensive written discovery, preparing percipient and expert witnesses for depositions and trial, taking and defending percipient and expert depositions, researching, drafting and arguing substantive motions including summary judgment, and drafting jury instructions.

REPRESENTATIVE MATTERS
- Negotiated and resolved numerous multimillion dollar wrongful termination, sexual harassment, and discrimination lawsuits on behalf of SRC business clients.
- Successfully defended the owner of two dozen franchises in employee classification lawsuit seeking unpaid overtime wages, a plethora of statutory penalties for Labor Code violations, and attorney’s fees.
- Trial Team member in multimillion dollar product liability lawsuit against Shell Oil Company, in what was then the longest civil jury trial in San Luis Obispo County history.
- Successful resolutions of claims involving unpaid wages, misappropriation of trade secrets, breach of contract, trademark infringement, and fraud, for and on behalf of business clients, including internet company, software designer, auction house, nursery, paper manufacturer, commercial printer, and commercial real estate broker, among others.
- Successfully struck punitive damage claim and eroded a $500,000 wrongful termination and unpaid wages lawsuit down to a nuisance value settlement on the eve of trial on behalf of a small employer.
- Defeated or greatly reduced unpaid wage claims before the Labor Commissioner.
- Obtained six-figure settlements in unpaid commissions and wrongful termination suits on behalf of individual clients.
- Defended multimillion dollar intentional interference lawsuit in notorious international military weapons procurement.
- Obtained dismissal of breach of contract action alleging $500,000 in damages based on federal law preemption.
- Obtained judgment and fees in favor of client, a multimillion dollar public corporation that extends financial services to attorneys, and defeated allegations of usury violations.
